{"id":43,"date":"2023-03-08T11:37:00","date_gmt":"2023-03-08T10:37:00","guid":{"rendered":"https:\/\/gaviaspreview.com\/wp\/paroti\/?p=43"},"modified":"2023-11-10T12:00:14","modified_gmt":"2023-11-10T11:00:14","slug":"why-organic-food-may-be-good-for-you","status":"publish","type":"post","link":"https:\/\/www.ong-prevoyance.net\/index.php\/2023\/03\/08\/why-organic-food-may-be-good-for-you\/","title":{"rendered":"C\u00f4te d\u2019Ivoire : Quelles sont vos moyens de d\u00e9fense en situation de harc\u00e8lement SEXUEL ?"},"content":{"rendered":"<p>Lors d\u2019une relation de travail, un contrat de travail plus pr\u00e9cis\u00e9ment, un homme ou une femme peut faire l\u2019objet de convoitise \u00e0 des fins sexuelles de la part de son employeur ou du repr\u00e9sentant de son employeur.<\/p>\n<p>La pr\u00e9sente a pour but de l\u2019aider \u00e0 \u00e9viter de contracter une relation sexuelle non consentie, en sus de prot\u00e9ger son emploi.<\/p>\n<p>A cet effet, il sied donc de cerner la d\u00e9finition juridique du harc\u00e8lement, de d\u00e9finir les moyens de la preuve avant d\u2019en tirer les cons\u00e9quences sur les parties (employeur et travailleur).<\/p>\n<h2 class=\"wp-block-heading\">I- La d\u00e9finition du harc\u00e8lement sexuel<\/h2>\n<p>Du moyen tir\u00e9 de l\u2019alin\u00e9a 4 de l\u2019article 5 du code du travail, l\u2019harc\u00e8lement sexuel est d\u00e9fini comme \u00e9tant les comportements abusifs, les menaces, les attaques, les paroles, les intimidations, les \u00e9crits, les attitudes r\u00e9p\u00e9t\u00e9s \u00e0 l\u2019encontre d\u2019un salari\u00e9, dont le but est d\u2019obtenir des faveurs sexuelles \u00e0 son profit ou au profit d\u2019un tiers.<\/p>\n<p>En somme, l\u2019approche juridique du harc\u00e8lement sexuel se r\u00e9sume \u00e0 la finalit\u00e9 sexuelle recherch\u00e9e par l\u2019ensemble des comportements d\u00e9crits ci-dessus. La question l\u00e9gitime qui revient est donc de savoir comment prouver la finalit\u00e9 sexuelle des agissements du harceleur pr\u00e9sum\u00e9, surtout quand il fait preuve de prudence dans ses agissements ?<\/p>\n<h2 class=\"wp-block-heading\">II- la preuve du harc\u00e8lement sexuel<\/h2>\n<p>Du moyen tir\u00e9 de l\u2019alin\u00e9a 6 de l\u2019article 5 du Code du Travail : le harc\u00e8lement se prouve par tout moyen. Au terme dudit article en son alin\u00e9a, la victime pr\u00e9sum\u00e9e d\u2019un harc\u00e8lement peut apporter la preuve de ses accusations par divers moyens recevables devant l\u2019inspecteur du travail ou le juge du travail.<\/p>\n<p>Ce sont :<\/p>\n<ul>\n<li>Des SMS et appels re\u00e7us en dehors des heures de travail ou des heures tardives;<\/li>\n<\/ul>\n<ul>\n<li>Des enregistrements de d\u00e9clarations peu catholiques et sans liens avec le service;<\/li>\n<li>Des sanctions non justifi\u00e9es induisant des abus d\u2019autorit\u00e9 ( on parlera plus d\u2019harc\u00e8lement moral)<\/li>\n<\/ul>\n<ul>\n<li>Des mises en situation en dehors du protocole r\u00e9glementaires du service ;<\/li>\n<\/ul>\n<ul>\n<li>De ces moyens de preuves, d\u00e8s l\u2019instant o\u00f9 elles peuvent fonder la religion de l\u2019inspecteur du travail ou du juge du travail sur leurs finalit\u00e9s \u00e0 caract\u00e8re sexuel dira recevable lesdites preuves.<\/li>\n<\/ul>\n<h2 class=\"wp-block-heading\">III \u2013 les cons\u00e9quences<\/h2>\n<p>En cas de moyens capables de soutenir la th\u00e8se d\u2019un harc\u00e8lement sexuel, deux options s\u2019offrent au travailleur<\/p>\n<h3 class=\"wp-block-heading\">A- le maintien de la relation contractuelle<\/h3>\n<p>Du moyen tir\u00e9 de l\u2019article 6 du Code du Travail, le travailleur peut saisir l\u2019inspection du travail aux fins de faire cesser cet abus. La bonne nouvelle est que l\u2019article susdit dispose qu\u2019en aucun cas le travailleur ne peut faire l\u2019objet de licenciement pour avoir \u00ab engager une proc\u00e9dure judiciaire aux fins de faire respecter ses droits \u00bb Tout licenciement du travailleur sera r\u00e9put\u00e9 abusif.<\/p>\n<p>Par cons\u00e9quent il est ind\u00e9niable que le travailleur jouira d\u2019une bonne immunit\u00e9 au service\u2026m\u00eame pour certaines fautes qu\u2019il commettra ( l\u2019\u00e9p\u00e9e de Damocl\u00e8s planant sur la t\u00eate de l\u2019employeur)<\/p>\n<h3 class=\"wp-block-heading\">B- La rupture du contrat du travail \u00e0 la charge de l\u2019employeur<\/h3>\n<p>Du moyen tir\u00e9 de l\u2019article 18.16 du Code du Travail, un travailleur peut rompre un contrat de travail et cela sera consid\u00e9r\u00e9 comme un licenciement abusif op\u00e9r\u00e9 par son employeur.<\/p>\n<p>A cet effet l\u2019article pr\u00e9voit que les causes de la rupture ne lui sont pas imputables ; en termes plus simples le travailleur rompt le contrat pour des motifs qui ne lui sont pas personnels mais contre sa volont\u00e9.<\/p>\n<p>Ainsi, le travailleur ayant flair\u00e9 une opportunit\u00e9 de boulot plus propice ailleurs pourra invoquer une d\u00e9mission du fait d\u2019harc\u00e8lement sexuel dont il d\u00e9tient les preuves et l\u2019employeur se verra contraint \u00e0 le d\u00e9dommager comme s\u2019il l\u2019avait licenci\u00e9 abusivement.<\/p>\n<p>Pour rappel, l\u2019article 18.16 du Code du Travail est un article beaucoup m\u00e9connu par les travailleurs dont plusieurs ont rendu des d\u00e9missions pour des motifs qui \u00e9taient ind\u00e9pendants de leur volont\u00e9.<\/p>\n<p>La d\u00e9mission par invocation dudit article pr\u00e9serve tous les droits que vous perdez normalement avec la d\u00e9mission<\/p>\n<p><strong>Source<\/strong>\u00a0: Olivier ZEZE, Inspecteur du travail et des Lois Sociales<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lors d\u2019une relation de travail, un contrat de travail plus pr\u00e9cis\u00e9ment, un homme ou une femme peut faire l\u2019objet de convoitise \u00e0 des fins sexuelles de la part de son employeur ou du repr\u00e9sentant de son employeur.<\/p>\n","protected":false},"author":1,"featured_media":2159,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-43","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-sante"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.0 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>C\u00f4te d\u2019Ivoire : Quelles sont vos moyens de d\u00e9fense en situation de harc\u00e8lement SEXUEL ?
