Et, c\u2019est le cas d\u2019une dame qui a eu son concours de la fonction publique et qui ne pouvait pas attendre vu que les cours avaient commenc\u00e9s.<\/p>\n<p>La loi dit qu\u2019avant tout d\u00e9part d\u2019une entreprise, vous devez obligatoirement respecter une p\u00e9riode de pr\u00e9avis.<\/p>\n<p>Mais, si je ne fais pas de pr\u00e9avis et que je pars, quels sont les droits que mon employeur me donnera ?<\/p>\n<p>Le principe de Droit est clair ici. Celui qui ne respecte pas de pr\u00e9avis est tenu de payer \u00e0 la partie adverse, des dommages-int\u00e9r\u00eats \u00e0 hauteur du montant du pr\u00e9avis.<\/p>\n<p>En d\u2019autres termes, si moi l\u2019employ\u00e9 doit faire un pr\u00e9avis de 3 mois avant de partir et que je ne fais pas, je payerai \u00e0 mon employeur trois (3) mois de dommages-int\u00e9r\u00eats qui est \u00e9gal \u00e0 mon salaire \u00d7 3.<\/p>\n<p>Dans ce cas, s\u2019il y a un quelconque droit \u00e0 me verser, je n\u2019aurai rien. Il en est de m\u00eame pour l\u2019employeur qui chasse son employ\u00e9 sans lui donner de pr\u00e9avis. L\u2019employeur payera aussi au travailleur, des dommages-int\u00e9r\u00eats \u00e0 hauteur du montant du pr\u00e9avis plus ses droits.<\/p>\n<h2 class=\"wp-block-heading\">Quelle est la dur\u00e9e du pr\u00e9avis que vous devriez respecter ?<\/h2>\n<p>La dur\u00e9e du pr\u00e9avis est \u00e9tablie en fonction de la cat\u00e9gorie du travailleur et de son anciennet\u00e9 dans l\u2019entreprise. Mais, retenez que pour une personne qui a fait un, deux, trois ans dans l\u2019entreprise, elle pourra faire un pr\u00e9avis de un ou deux mois.<\/p>\n<p>Pour une personne qui a fait 5 ou plus de 5 ans, je vous conseillerais de faire 3 mois de pr\u00e9avis.<\/p>\n<h2 class=\"wp-block-heading\">Comment contourner le pr\u00e9avis ?<\/h2>\n<p>Pour contourner le pr\u00e9avis, avant de d\u00e9missionner, il faudrait mettre sur la lettre de d\u00e9mission:? LETTRE DE DEMISSION SUIVIE D\u2019UN PR\u00c9AVIS DE \u2026. MOIS.?<\/p>\n<p>Faites votre lettre en deux copies et exiger une d\u00e9charge sur la copie. Mais, vous faites 2 (deux) semaines dans l\u2019entreprise et vous pourrez partir.<\/p>\n<p>\u00c7a sera apr\u00e8s, parole contre parole et vous, vous aurez raison parce que la preuve est votre d\u00e9charge \u00e0 vous.
